New Zealand Government Reveals the Final Cannabis Legislation for Voting in Referendum

Whether New Zealanders vote for the legalization of cannabis or not, in this year’s planned upcoming referendum, the purchase of edible cannabis products will not be allowed with immediate effect by the government.

To be considered by the public, the final legislation was published on the morning of Friday, May 1. The legislation outlines a phased approach regarding the hopeful legalization of the drug.

Specific cannabis products would be approved for production and sale, with immediate effect, under the new regime. The products are only fresh and dried cannabis, which includes plants and seeds.

A recommendation could later be given by a new Cannabis Regulatory Authority, regarding the approval of edible cannabis as well. However, beverages or novelty products, like gummy bears will not be included.

Specific requirements set by the government will have to be met by cannabis edibles, for approval. The requirements include the production in premises to be separate from conventional food production. Furthermore, if the edible cannabis products are found to be appealing to children and young citizens, the products would be banned.

Moreover, anyone found selling cannabis to under 20-year-old citizens, could potentially land the person in a four-year prison term. Furthermore, selling cannabis without a valid license can lead to a penalty of up to two years in jail. Breaching license provisions are one of the other offenses that carry hefty fines.

However, anyone under the age of 20, found to have possession of cannabis, will eventually get themselves a health-based response such as an education session. If not the session, they will have to pay a small fine, ensuring that they would not get a conviction.

One of the main psychoactive compounds found in cannabis is tetrahydrocannabinol (THC). The levels of THC are subject to limits. Hence, products need to be labeled accurately with the amount of THC and CBD (cannabidiol).

Retailers will not be allowed to sell any cannabis or cannabis products at a reduced price, or to give the products away free of cost. Furthermore, the advertising of products would be banned.

The taxing of the products will be executed. Additionally, a levy, which will be similar to which is applied to alcohol and gambling, would fund services needed for the reduction in cannabis harm.

Details that were made public last year are confirmed in the bill. This includes an age limit along with a maximum purchase limit.

A person who is aged 20 or over, per day, will only be able to purchase up to 14 grams of dried cannabis (or its equivalent). The purchase can only be made from licensed outlets, and the consumption of cannabis will be allowed on private properties or at licensed venues only. Moreover, up to two plants will be allowed to be grown, with a maximum of four plants per household.

There have been updates regarding the draft Cannabis Legalisation and Control Bill. The details included are –

  • the way the cannabis market would work, along with the phased introduction of cannabis which will start with fresh and dried cannabis, cannabis plants and seeds
  • how the regulation of consumption (of cannabis) premises would work
  • the process of approval for cannabis products, along with the regulation regarding the prohibition of products
  • the licensing requirements
  • how the Bill proposes the reduction of the exposure of young people to cannabis; and
  • infringements and penalties

Do you support the proposed Cannabis Legalisation and Control Bill?

If it passes, the Parliament will put through the legislation to make it legalized. During the general election, the referendum will be one of the two taking place.

But Rep. Winkler disagrees with the Republican point of view. According to Paal Carter, the tobacco and alcohol industries are working effectively within regulations, and the cannabis industry will work likewise by following cannabis legalization and decriminalization bills.

Winkler clarifies that the formulation of the cannabis legalization bill represented in the House took over two years. After completing research, talking to law enforcement, and considering public health officials’ opinions and concerns, the bill formulation occurs. Thus, there is nothing to worry about, and the bill is all set to pass.

Possible Changes that Can Occur After Approval of Cannabis Legalization Bill 

The passing of this bill will enable the legal business and sales of cannabis products.
