According to research, marijuana is the most widely used illicit drug in New Zealand. Although the present marijuana laws in the country do not permit unauthorized possession or use of the drug, about 80% of New Zealanders have admitted to using marijuana at least once by the age of 21.

This huge percentage of users reflects that the prohibitory measures surrounding the drug are proving to be ineffective in the country. Data collected by the New Zealand Drug Foundation further confirms this scenario. Their statistics have shown that around 74,000 tonnes of cannabis are consumed each year in the country.

When it comes to analyzing the wastage of resources in implementing these laws, the figures are overwhelming. Each year, the police spend around 330,000 hours on enforcing marijuana laws, which are failing to show any significant impact. In addition, taxpayers’ money that is spent to fund these flouting laws amounts to around $200 million dollars.

Overview of Marijuana Laws in New Zealand

Marijuana usage in New Zealand is regulated through the Misuse of Drugs Act 1975. Up until 2018, the usage, possession, and cultivation of marijuana were strictly banned in the country.

In 2018 however, a bill was passed to allow the medicinal usage of marijuana for limited medical conditions. Later in 2019, the Misuse of Drugs Amendment bill was implemented that ended prosecutions for mere possession of marijuana. After this, an announcement was made that a referendum would be held for legalizing the recreational use of marijuana during the 2020 elections.

As of now, penalties related to marijuana can result up to a fine of $500 for possession. Convicts found guilty of supplying or manufacturing it can be subjected to a jail time of 14 years.

In addition, those involved in the cultivation of the plant can be jailed for 7 years or 2 years of jail time along with a $2000 fine.

Marijuana Laws and Penalties for Under Age Users

Although marijuana laws in New Zealand have a provision that discourages arrests for mere possession, the laws are a little different for younger people.

Individuals under the age of 17 found smoking or possessing marijuana are at risk of getting arrested. The country has a special department to deal with this age group called the Police Youth Aid. Convicts will be directed to this department if the amount of cannabis possessed is below a limit to be worthy of supply. The Police Youth Aid will take one of the following actions:

  • Convicts might be issued a warning
  • they may be offered alternate action or diversion – typically provide if they are first-time offenders. For such cases, the individuals are liable to pay donations, sometimes along with a counseling course
  • family group conference techniques may be applied for proper counseling
  • Cases may be taken to Youth Court if offenses are of a serious nature

Recreational Marijuana Legalization Measure Fails

Statistics of high usage of marijuana among New Zealanders had led legalization advocates to become positive about its successful recreational usage to become legal in the 2020 referendum.

In the general elections of 2020, voters were asked their verdict on two referendums related to marijuana legalization. The referendum had proposed the legalization of cultivation, possession, and exchange of marijuana for adults 21 or older.  Possession of up to 14 grams of dried cannabis was also deemed permissible. In addition, a maximum limit of four plants per household was suggested.

Some restrictions liable on the industry included the following:

  • no advertising
  • publicly using the drug would have been prohibited
  • a regulatory authority would overlook the operation of retail, supply, licensing, and location of retail outlets.

Even before the referendum was held, voters were assured that the laws surrounding the medicinal usage of marijuana. Lawmakers assured that the reason behind this legalization referendum was to mitigate the illicit market. In addition to this, it was being carried out to ensure public safety, and gain control over the quality of products that are being used by the public.

The referendum failed by a very narrow margin. Most experts associate this with the global pandemic and another question placed on the referendum. This question was related to euthanasia and it is believed that it stole the attention of voters.
